Rules and Regulations

- Venue:
The Fairs and Conventions Centre, Ta' Qali.
- Interpretation of Terms:
In these conditions of participation, the following terms shall have the following meaning:
"Agreement" means the participation agreement entered into between the Organisers and the Participant which incorporate these conditions of participation. "Fair" shall mean the fairs for which this agreement is made out. "Organisers" shall mean Ceramart Ltd. Events & Consultancy and Malta Fairs and Convention Centre Ltd, their employees, contractors and agents.
- Participation Fee:
The participation fee covers only the period of the Exhibition. It entitles the Participant to the use of the Exhibition space, electricity services and normal electricity consumption. Participation fee may be paid either for floor space or floor space and shell scheme. The Participation fee for floor space only does NOT entitle the Participant to: Fittings and Displays, Floor coverings, Interior decorations and furniture, Electrical connections and installations and all other special requirements. When a Participant pays a fee for participation and shell scheme s/he is entitled for carpeting, back/side panels, 1 power supply, spotlights and name fascia.
- Conditions of Payment:
Upon signing the agreement, the Participant shall pay a deposit/full payment in respect of the fee due under the agreement. The Participant shall not be permitted to make use of exhibition space if the participation fee or other accounting balance are not paid in full.
- Failure to Exhibit and Cancellation Policy:
Any participant, who, on the opening of the Exhibition, fails to exhibit, shall have no right to claim refund of the participation fee or any form of loss or damage. At the same time, the Organisers shall have the right to dispose of the stand or site in question. Oncesigned, this agreement is binding and payable in full. An Exhibitor may cancel his participation under the following terms:
- in writing 2 months prior to the event date - any deposit paid is not refundable,
- in writing 1 month prior to the event date - any deposit paid is not refundable and is liable to a 50% + tax of the total floor space booked. Any other method of cancellation will be considered as a breach of the terms and conditions and the Exhibitor is liable to a full payment, including all taxes and expenses incurred on his behalf.
- Completion and use of Stands/Site:
The Participant, his employees, agents and contractors may enter the Exhibition grounds for the purpose of preparing the display during the work period established by the Organisers for the Exhibition. The Participant undertakes that the stand/site will be ready, and all exhibits prepared for display according to the timings as set out by the Organisers. Packing materials, storage boxes, rubble, etc. are to be removed by the participant. The cleaning of the respective stand is the responsibility of the Participant concerned unless otherwise agreed upon.
- Dismantling of Stands/Sites:
The Participant undertakes to remove from the exhibition complex all material being his property used during the participation as directed by the Organisers. Failure to comply by the said directive, within the period stipulated by the Organisers, will entitle the Organisers to dismantle the exhibits themselves at the sole risk and expense of the participant. In exercising this right, the Organisers will take all the necessary precautions to avoid damage/loss to the said materials, but they will not be held responsible for any damages that may occur.
- Permits and Licences:
The Participant must comply with the requirement of all public authorities. It shall be his responsibility to obtain all necessary permits and/or licences that may be required.
- Conduct of Participants:
Every Participant shall ensure that his stand/site is open to view by his competent representatives during the Exhibition hours. The Participant is not permitted to carry out work on his stand during the Exhibition hours. Every participant, and all persons for whom he may be considered responsible in any way whatsoever, must conduct himself in such a manner as shall not be objectionable to any other Participant or Participants' employee, visitor or to the Organisers, and shall not create any disturbance or obstruction. Any person who does not comply with these requirements shall be liable, at the discretion of the Organisers, to be removed from the Exhibition premises and refused re-admission during the period of the Exhibition. The Participant is not permitted to stack packing material or shutters in the passageways or other conspicuous place near the stands of other Participants where they will be visible to the public.
- Limitations of Participant's rights:
The Participant shall not assign the agreement, or make available his stand/site in whole or in part to another person, or in any manner whatsoever associate another person in the rights conferred by the agreement.
- Demonstrations:
The Participant may not exhibit in operation, without adequate protection and without written permission of the Organisers, motors, engines, contrivances or power driven machinery. Such permission may be withheld or withdrawn at any time should such machinery in operation be of a nature likely to cause, danger, annoyance or inconvenience to other Participants or visitors.
All efforts to advertise, promote sales, and operate exhibits must be conducted so as not to cause annoyance or inconvenience to other participants or visitors. The following are prohibited: solicitations (in person or by any sound process above the ordinary speaking tone of voice), or any practice resulting in a complaint from Participant or Visitor, which, in the opinion of the Organisers, expose annoyance or danger.
The Organisers reserve the right to determine the acceptable level of sound from working exhibits and audio/visual equipment in the event of complaints from other Participants or Visitors.
- Competitions and/or Lotteries:
Participants who may wish to hold on their stand competitions, lotteries or similar matter during the Exhibition, require the written permission of the Organisers. As a matter of policy, it should be noted that prizes offered in such lotteries and competitions and promotional give-aways, if not directly related to the scope of the Exhibition, might not be placed on display on the stand/site. However, the Organisers shall decide in every application for such display of prizes and/or give-aways on the merit of each and every case.
- Security:
The security of individual stands during the exhibition hours and, in particular, at the closing time of the Exhibition is the responsibility of the participant. Stands should not be left unattended at any time during the exhibition hours. During the closed hours of the exhibition, the TFS will be under surveillance of security personnel. However, the Organisers cannot accept any liability for any loss or damage to any stand, participant materials, goods, property or personal items, however such loss should be sustained. It is the responsibility of the individual Participant to ensure that his stand, exhibits and personal property are secure at all times. In the unlikely event that Participants sustaining losses from their stands, such losses should be reported immediately to the Organisers and the police. The registering of the complaint by the Organisers shall in no way be deemed to constitute or imply admission of liability.
- Insurance
- Third Party Liability: Visitors to the Exhibition will be covered by public liability insurance. This insurance does not cover the participants stand/site and dependants or exhibits.
- Third party claims: The participant is responsible for any death, personal injury or damage to the property arising in connection with the erection and dismantling of the participant's stand and anything permitted, omitted or done thereon or there from during the period of the exhibition or the construction and dismantling periods caused directly or indirectly by the Participant or any contractor, subcontractor, employee, agent, licensee or invitee of his or the act, omission or neglect of any such person or by such person or any exhibit, machinery, or other article or thing of the participant or in the possession of or use of the participant or employee or agent of his. The participant will indemnify the Organisers in respect of each and every such claim and all actions, proceedings, cost, claims and demands in respect thereof. It is recommended that the participant takes out adequate insurance in respect to all such claims.
- Participant's staff and exhibits at the exhibition: The Organisers shall not be responsible in any way for death, personal injury to the participant or his employees, agents, invitees, or licensees howsoever caused nor the theft or damage to exhibits or to the property of the exhibitor, his employees, agents, invitees, or licensees howsoever caused.
- Consequential loss: The Organisers accept no liability for any costs and losses, which the Participant may incur, in the event of the exhibition being prevented, postponed or abandoned for causes not within the Organisers control.
- Admission to the Fair:
The Organisers reserve the right, at their discretion, to refuse the admission to the Exhibition to any person, if complaints have been received concerning conduct.
- Electricity Service:
Electrical Installations and equipment must conform with regulations of EneMalta Corporation. In particular, every stand must have a circuit breaker (16amps MCB and 40 amps 30mAELCB). The connection to the electricity supply shall be effected by MFCC employees ONLY. The Organisers will supply the required load provided the existing installation feeding the stand can take such load; otherwise the Participant's electrical requirements can only be supplied if he undertakes in writing to meet the expenses thereby involved. The Participant shall be liable for any damage to the exhibition's general installation or any loss of electrical supply caused directly or indirectly by the Participant or any contractor, subcontractor, employee, or agent or licensee of his. The Organisers reserve the right to carry out tests and surveys of electrical installations as it is deemed necessary. The Organisers will use their best endeavours to ensure the supply of electricity service however the Organiser shall not incur any liability to the Participant for any loss or damage if this service shall wholly or partially fail to cease to be available.
- Damage to Buildings/Structure:
The Participant shall not cause or permit any damage to the Exhibition structure or any part thereof or to any of the fixtures and fittings therein not the property of the Participant and shall not alter or interfere with the structure of the Exhibition premises. The Participant shall immediately repair any such damage occurring during the period within which the site or stand is available to the Participant, in breach of this regulation. In particular, but without prejudice to the generality of the foregoing, no nails or screws shall be driven or holes drilled in the floor, walls, doors, pillars, or other parts of the structure of the Exhibition buildings.
- Cancellation of Exhibition:
If the Exhibition is abandoned, cancelled, or suspended in whole or in part, by reason of war, fire, national emergency, labour dispute, strike, lock-out, civil disturbance, inevitable accident, the non availability of the Exhibition structure, or any other cause not within the control of the Organisers, the Organisers may at their entire discretion, repay the participation fee paid by the participant, or part thereof, but shall under no circumstance be under no obligation to repay the whole part of such participation fee, and shall under no liability to the Participant in respect of any actions, claims, losses (including consequential losses), costs or expenses whatsoever which may be bought against or suffered or incurred by the Participant as a result of the happening of any such.
- Organisers' right to cancel:
If a Participant shall, during the period for which the site or stand is made available to him, be guilty of any serious or persistent breach of any of the rules and regulations, after complaint shall have been made to him, the agreement may be cancelled by the Organisers forthwith by notice in writing to such Participant. In such event, the exhibits of such participant shall be removed from the Exhibition at a time to be stated by the Organisers and thereafter, such participant, his employees and agents shall not be entitled to access the Exhibition premises. The Organisers shall be entitled, if necessary, to remove and despatch the said exhibits and property (at the risk and expense of the participant) to the address of the participant stated on the agreement. The participation fee paid by the Participant shall not be in whole or in part refunded in the event of cancellation under this regulation, which shall in any event be without prejudice to all rights and claims whether for unpaid fees, damages or otherwise by the Organisers against such Participant.
- Failure of Service:
The Organisers will use their best endeavours to ensure the supply of services; but as the supplies of certain services are not within the control of the Organisers, they shall not incur any liability to the Participant for any loss or damage, if any such services shall wholly or partially fail to cease to be available, nor shall the Participant be entitled to any allowance in respect of participation fees due or paid under the agreement.
- Rights of the Organisers:
The Organisers and those authorised by them, have the right to enter the Exhibition premises, sites and stands at any time to execute works, repairs, and alterations and for other purposes related with Exhibition services.
- Non-Compliance with Regulations or Breach of Agreement:
In the event of any failure on the part of the participant to observe and perform any of the provisions of the agreement, the Organisers shall have the right to terminate the agreement forthwith by written notice to that effect, in which event all fees then paid by the Participant shall be forfeited and retained by Organisers, and the participant shall indemnify the Organisers of all costs, losses, damage or expenses (including any consequential loss or damage) incurred as the result of such failure.
- Exemptions:
Exemption from any of the rules and regulations may be granted at the Organisers' discretion. No exemption given by the Organisers will be effective, unless it is in writing.
- Decision:
In all matters regarding these rules and regulations, the decision of the Organisers is final. Should any question arise that is not covered by these rules and regulations the participant binds himself to accept the decision of the Organisers as final.
